1. Use of Service and Eligibility

• Account: You must register with accurate information and keep it updated. You are responsible for all activity under your account.
• Age:You must be at least 16 years old to use Sounday. If you are under 18, you must have a parent or guardian's consent.
• Updates: We may change or discontinue features at any time. If you continue using the service after changes, you accept the updated Terms.

2. How Sounday Works

Sounday lets you create stations — personalized audio feeds built from topics and sources you choose. We fetch content from your sources, generate scripts using AI, and produce audio episodes you can listen to.

• Private stations are visible only to you (or your workspace members).
• Public stations are discoverable by anyone. You can share them via link or RSS feed for podcast apps.

3. Content and Licensing

Your content

You own all content and inputs you provide (station names, source links, topics, and any text you upload). You also own the generated scripts and audio for your stations, subject to third-party rights. We do not claim ownership of your content or output.

License to Sounday

By using the service, you grant Sounday a worldwide, non-exclusive, royalty-free license to use, store, reproduce, and distribute your content as needed to provide the service. For public stations, this includes making your episodes available via RSS, share links, and any distribution features.

Sources and third-party content

You are solely responsible for ensuring you have the right to use each source you add — including RSS feeds, newsletters you forward, and documents you submit. You represent that your use of those sources for the purposes described here does not infringe any third party's copyright, trademark, or other rights.

Sounday does not verify the legality of your sources, does not pre-moderate the content fetched from them, and is not responsible for third-party content accessed through them.

How Sounday uses your sources

Sounday ingests source content to produce a new, transformative work — a short AI-generated audio episode containing summary, synthesis, and commentary on the underlying material. Episodes are not verbatim copies of any source.

By default, episodes are generated for your personal use on a private station. If you choose to make a station public or share an episode publicly, you additionally represent that:

• You have the right to communicate the transformed episode publicly, or your use is otherwise permitted (e.g. fair use / fair dealing / cita e ilustración under Spanish copyright law, Art. 32 LPI).
• You will not use Sounday to systematically republish copyrighted material without authorisation.

If we receive a valid copyright complaint about an episode or station, we will remove it under our takedown process (section 5).

AI-generated content

Episodes are generated using AI and voice synthesis. AI-generated content may contain inaccuracies, omissions, hallucinations, or errors. Sounday makes no guarantee that episodes are complete, accurate, or suitable for any purpose — including factual reporting, investment advice, medical advice, or legal advice. Use at your own discretion and verify before relying on anything an episode says.

4. Prohibited Conduct

You agree not to:

• Upload or link to illegal, infringing, harassing, or hateful content.
• Use the service to violate any law or anyone's rights.
• Scrape, mass-download, or systematically extract content from Sounday.
• Reverse-engineer, decompile, or manipulate our software.
• Use the service to build a competing product.
• Interfere with or disrupt the service or its infrastructure.

We may remove content or suspend accounts that violate these rules.

5. Copyright and DMCA

We respect intellectual property rights. If you believe content on Sounday infringes your copyright, you may send a takedown notice to support@sounday.ai including:

• A description of the copyrighted work.
• The location (URL) of the infringing material on Sounday.
• Your contact information.
• A statement that you have a good-faith belief the use is not authorized.
• A statement that the information is accurate, under penalty of perjury.
• Your signature (physical or electronic).

Upon receiving a valid notice, we will remove or disable access to the content. If your content is removed by mistake, you may send a counter-notice.

We will terminate accounts of users who repeatedly infringe copyrights.

6. Price

Sounday is currently free to use. If we introduce paid features in the future we will update these Terms and give you clear pricing and billing information before charging anything. No payment details are collected until then.

7. Termination

• By you: You can delete your account at any time in your account settings. Your stations and data will be removed per our data retention policy.
• By us: We may suspend or terminate your account if you breach these Terms, engage in harmful behavior, or upon extended inactivity. We will notify you when reasonable.

On termination, your right to use the service ends. Provisions about content licenses, liability, indemnity, and dispute resolution survive termination.

8. Disclaimers and Liability

Disclaimer

The service is provided "AS IS" and "AS AVAILABLE." We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be error-free, uninterrupted, or that generated content will be accurate.

Limitation of liability

To the fullest extent permitted by law, Sounday's total liability to you for any claim arising from the service is limited to the amount you paid us in the 12 months before the claim, or $100 if you paid nothing. We are not liable for indirect, incidental, special, or consequential damages.

Some jurisdictions do not allow certain limitations, so these may not apply to you.

Indemnification

You agree to indemnify and hold Sounday harmless from any claims, damages, or expenses arising from your use of the service, your content, or any breach of these Terms.

9. Privacy

Our Privacy Policy explains how we collect, use, and protect your information. By using Sounday, you agree to the practices described in the Privacy Policy. If you are in the EU/UK, you have rights under the GDPR. If you are in California, you have rights under the CCPA/CPRA. See our Privacy Policy for details.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain, without regard to conflict-of-law principles. Any dispute arising from these Terms or from your use of the service will be resolved exclusively by the competent courts of the city where Sounday has its registered office, unless mandatory consumer-protection rules apply in your country of residence (in which case those rules prevail to the extent they are more favourable to you).

Consumer rights.If you are a consumer resident in the European Union, nothing in these Terms limits the statutory rights you have under applicable EU consumer-protection law. You may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

11. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will notify you via email or in-app notification before they take effect. Your continued use of Sounday after changes means you accept the updated Terms.
